미국에서 기능식 청구항은 인정되나 명세서에서 뒷받침되는 실시예들에 한정되어 권리범위가 인정된다. 우리나라도 명시적인 판례는 없으나, 특허법원 이하 판례 등을 참고하면 미국과 유사한 경향이다. (상세한 확인 필요)
